Terms of Service
1. Who we are
Be'ing Here is a spiritual and wellness membership platform offered by Be'ing Here LLC, founded by Mandy-Lynn Aitken and Cherise Pollard and based in West Chester, Pennsylvania, United States. The Sacred Path is our members' space: teachings, audio and video sessions, journals, trackers, and a quiet community. These terms are the agreement between you and Be'ing Here LLC when you create an account or use the platform.
2. Who may join
You must be at least 18 years old to create an account. By joining, you confirm that you are 18 or older and able to enter into this agreement.
3. Your account
Your account is yours alone. You agree to give us accurate information when you join, to keep your password private, and not to share your account with anyone else. You are responsible for what happens under your account, and you agree to tell us promptly if you believe someone else has used it. We may need to reach you about your account using the email address you gave us.
4. Membership and subscriptions
Some parts of the Sacred Path are, or will become, paid memberships. When paid memberships are active, the following applies:
- the price, billing period, and what is included are shown clearly before you pay, and you give your affirmative consent to those terms at checkout;
- subscriptions renew automatically at the end of each billing period, at the price and frequency shown, until you cancel;
- you may cancel at any time, online, through your account settings — cancelling is as easy as signing up, and never requires a phone call — and your access continues until the end of the period you have already paid for;
- for annual plans, we send you a reminder before the plan renews;
- if we change a subscription price, we tell you in advance, and the new price applies only from your next renewal.
Fees already paid are non-refundable except where the law requires otherwise or where we say so in writing — see our Refunds & Cancellations policy.
5. Payment, prices, and taxes
Payments are handled by a third-party payment processor; we do not store your full card details. Prices are shown before you pay, and any applicable taxes are added and shown at checkout. You authorise us and our processor to charge your chosen payment method for your plan and any renewals. If a payment fails, we may retry it and may pause your access until it clears.
6. Refunds
How refunds and cancellations work — including that memberships and one-on-one services are non-refundable — is set out in our Refunds & Cancellations policy, which forms part of these terms.
7. Our content
Everything we offer inside the Sacred Path — teachings, courses, written material, audio recordings, video, card imagery, artwork, and the design of the platform itself — remains the property of Be'ing Here or its licensors. Your membership gives you a personal, non-transferable licence to use this content for your own practice while your membership is active. It does not give you the right to copy, record, redistribute, sell, publicly perform, or use the content to build a competing offering, and it does not transfer any ownership to you.
8. Your content, and reporting infringement
What you write in the Sacred Path — journal entries, tracker notes, community posts — remains yours. You give us only the technical permission we need to store and display it back to you (and, for community posts, to the members you share it with) so the platform can work. Your journal is private to you; see the Privacy Policy for how we treat it. You are responsible for what you post, and you confirm you have the right to post it.
If you believe something on the platform infringes your copyright, write to us at gandalf.white@be-inghere.com with enough detail to identify the work and where it appears, and we will review it and remove infringing material where appropriate under the Digital Millennium Copyright Act (DMCA).
9. Acceptable use
In the Sacred Path, you agree not to:
- harass, demean, or harm other members, or disrupt the community space;
- impersonate any person, or misrepresent who you are;
- share your login, or access another member's account or private content;
- copy, scrape, download, record, or redistribute platform content outside your own personal use;
- use the platform for anything unlawful, or interfere with how it runs.
10. A note on wellbeing
Everything offered through Be'ing Here is spiritual and educational in nature. It is not medical, psychological, or therapeutic advice, and it is not a substitute for care from a qualified professional. If you are facing a physical or mental health concern, please work with a doctor, therapist, or other licensed practitioner — and if you are in crisis, contact your local emergency services right away. 11. Disclaimers
The Sacred Path is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties that the platform will be uninterrupted or error-free, and we do not promise any particular result from the teachings or practices. Certificates awarded are certificates of completion, not professional certifications or licences.
12. Limitation of liability
To the maximum extent permitted by law, Be'ing Here LLC, its founders, and its people are not liable for indirect, incidental, or consequential losses arising from your use of the platform, and our total liability to you is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited under the law that applies to you.
13. Indemnification
You agree to indemnify and hold harmless Be'ing Here LLC, its founders, and its people from claims, losses, and reasonable costs arising out of your misuse of the platform, your breach of these terms, or content you post.
14. Ending things
You may close your account at any time. We may suspend or close an account that breaches these terms, harms other members, or uses the platform unlawfully — where it is fair to do so, we will tell you why and give you a chance to make it right. When an account closes, your licence to use our content ends; you may ask us for a copy of your own content, or for its deletion, as described in the Privacy Policy.
15. Governing law and venue
These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules, and you and Be'ing Here LLC agree to the courts located in Pennsylvania for any dispute that is not otherwise resolved.
16. Changes to these terms
We may update these terms as the platform grows. If a change matters, we will tell you — by email or inside the Sacred Path — before it takes effect, and update the date above. Continuing to use the platform after a change takes effect means you accept the updated terms; if you do not, you may close your account.
